Aiii – Briefly outline why employment law exists

Employment law regulates the relationship between employers and employees. It governs what employers can expect from employees, what the employers can ask the employee’s to do and what the employees’ rights at work are.
Task B – Your work role

Bi – Describe the terms and conditions of your employment as set out in your contract of employment or employment agreement.

My contract contains the following information in its Terms and Conditions:

• How much I will be paid and when I will be paid

The following information can be found on my payslip:
• The amount I am being pad before and after tax and any other deductions.
• The hourly rate that I will be getting paid.
• My national insurance number will be included as well as my tax code
• How I will be getting paid
• My name and address.
• My employer

Biii – identify two changes to personal information which you must report to your employer.

1. Change of address
2. Sickness or Absence

Biv – Describe the procedure to follow if you wanted to raise a grievance at work. You may describe this in writing or produce a flow diagram.

If there is a grievance then it must first be discussed with the manager of the setting. In the event that the grievance continues to persist then the manager will set up a meeting for further discussion.

If the grievance is serious the then employee or volunteer must put it in writing to the manager. Within 5 days of the manager receiving the grievance in writing, a meeting will be put in place to discuss the issues. The member of staff with the grievance has the right to bring another member of staff to the meeting with them.

After the meeting, the manager will give a decision in writing to the member of staff within 24 hours.

In the event that the member of staff / volunteer is unhappy with the result provided by the manger then they have the right to appeal the decision by letting the manager know. The employee will once again be invited to a meeting within 5 days and the appeal will then be heard. Again the decision will be sent to the employee / volunteer within 24 hours of the meeting. This decision will be final.

Bv – Explain the agreed ways of working with your employer in relation to the following areas:

1. Data protection
• Netanya Nature Pre-School are required to inform me of how they will process and store personal data within the setting. All paperwork is stored in the office, either in a locked filling cabinet or in the locked storage room. The laptop which holds the personal data is password protected and is only used management. All data is to be used for work purposes only even when used at the managers’ home address.
2. Grievance
• Informal – This would be a minor grievance e.g. doing my duties incorrectly.
• Formal – This would be a serious grievance e.g. problems with another member of staff.
3. Conflict Management
• To ensure that there is no conflict in the setting, it is best to communicate any issues with other members of staff to the relevant people in the setting. If the conflict becomes too great then a grievance should be raised in the correct manner.
4. Anti-Discrimination Practice
• We aim to provide a secure and accessible environment to all children so that they can flourish and that all contributions are considered and valued including the equality and diversity of all families. We will provide positive, non-stereotypical information about gender roles, diverse ethnic and cultural groups and people with disabilities.
5. Health and Safety
• In the Netanya Nature Pre-school Policies and procedures handbook, there are 9 main areas of health and Safety;
i. Awareness raising
ii. Children’s safety
iii. Security
iv. Kitchen
v. Electrical / gas equipment
vi. Storage
vii. Outdoor area
viii. Hygiene
ix. Activities
• These 9 areas aim to make the children, staff, parents, volunteers and visitors aware of health and safety issues and to minimise the hazards and risks that enable the children to thrive in a healthy and safe environment.
• In the event that I have any concerns with the health and safety of the setting then I should report this to the designated Health and Safety Officer.
6. Confidentiality
• We aim to ensure that all parents and carers can share their information in the confidence that it will only be used to enhance the welfare of their children. There are times, however when we are required to share information about a child or their family with other organisations. These could be in the event of; concerns that a child might be suffering significant harm, ‘reasonable cause’ to believe that a child is or maybe suffering from significant harm but it is not clear and if there is ‘serious harm’ to adults e.g. domestic violence.
• Information and records that are held regarding each child must be kept confidential and relevant to the child. This information must also be held safely and securely. Any requests for information regarding a child from an outside organisation, it must be done in writing to the manager of the setting and must include the relevance as to why they want it.
• The information that we keep regarding each child is accurate, factual, non-judgemental and up-to-date as per the safeguarding policies.
7. Whistleblowing
• Any concerns I have must raised in writing to my manage and should include the following information:
i. That it is a whistleblowing issue
ii. Background and history of the concern, names and dates and places where possible
iii. Reasons why I am concerned about the situation
• Alternatively if I fell unable to out this information in writing to the manager then I should contact the LADO.

Bvi – Explain how your role contributes to the overall delivery of the service provided

Bvii – Explain how you could influence the quality of service provided by;

a) Following best practice within your work role;

By ensuring that I am following the agreed way of working in my contract I can provide the best service possible and also build on new skills that I need to learn but also share any knowledge or information that I gain with other members of staff when I attend training courses. When following the codes of best practice it can influence the service that I provide by making sure I am working as a team player and using good communication skills to other members of staff and parents that I speak to in the setting. I will make sure that I check in with my manager and the codes of conduct/practice book to ensure I am up to date with any changes in legislation that I need to be aware of to make sure I am providing the best service possible.

b) Not carry out the requirements of your role

By not carrying out the requirements of my job role, I will be unable to provide the children in the setting a safe environment to be in.

Bviii – Describe how your own work must be influenced by National factors such as Codes of Practice, National Occupation Standards, Legislation and Government initiatives.

• A description of how the issue or area of public concern has affected service provision and methods of working
• A description of how public opinion is affected by issues and areas of concern in either the health, social care or children’s and young people’s sectors.

All children from the age of 3 can access 15 hours of funding for childcare a week (Gov.uk, 2018). From September 2017 the government made it possible for children aged 3 and 4 to have access to 30 hours of free childcare if they were eligible (pacey.org.uk, 2018).

To be able to have access to the free 30 hour funding, parents need to be in work and earning minimum wage for at least 16 hours a week. In the event that parents are unable to work then it is still possible to access the 30 hour funding if they are claiming one of the following benefits (Gov.uk, 2018):

• Severe Disablement Allowance
• Carers’ Allowance
• Employment and support Allowance
